These Terms of Service ("Terms") govern access to and use of the services provided by O'Neill FZ LLE ("Cavello," "we," "us," or "our"), the Free Zone Limited Liability Establishment trading as Cavello (Trade Licence No. 19638/2025, Fujairah Creative City Media Free Zone, UAE). By accessing or using our services, you agree to these Terms. If you do not agree, do not use the services.
1. The Services
Cavello provides social-media partnership, management, and analytics services. We aggregate and report content-performance analytics for client accounts we are authorised to manage, using official platform APIs and authorised data sources.
2. Eligibility & Accounts
Our services are intended for authorised team members of Cavello and its clients. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account, and must provide accurate information.
3. Authorisation to Access Platform Data
You represent that you have the necessary rights and authorisations for any social-media account you connect to, or ask us to manage or track. You will not use our services to access data for accounts you are not authorised to manage. Access to third-party platforms (Meta, YouTube, TikTok) is also subject to those platforms' terms, and you agree to comply with them.
4. Acceptable Use
- Do not use our services for any unlawful, infringing, or harmful purpose.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to our services or infrastructure.
- Do not use our services to violate the terms, policies, or rate limits of any connected third-party platform.
- Do not resell, redistribute, or misrepresent data obtained through our services.
5. Intellectual Property
Our services, including software, design, and content (excluding client data and third-party platform data), are owned by O'Neill FZ LLE and protected by applicable law. Client data remains the property of the respective client.
6. Third-Party Platforms & Data
Our services integrate with third-party platforms and depend on their APIs and availability. We are not responsible for changes, outages, or data discrepancies originating from those platforms. Data is provided "as reported" by the source platforms and may be subject to their own definitions, delays, and revisions.
7. Privacy
Your use of our services is also governed by our Privacy Policy.
8. Disclaimers
The services are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, O'Neill FZ LLE will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from or related to your use of the services.
10. Termination
We may suspend or terminate access to the services at any time for conduct we believe violates these Terms or is harmful to others. You may stop using the services at any time.
11. Governing Law
These Terms are governed by the applicable laws of the United Arab Emirates and the Fujairah Creative City Media Free Zone, without regard to conflict-of-laws principles.
